I recently appeared before a federal judge who is renowned for making rash decisions. In a clear case of abuse of discretion, he threw out a $56 million dollar lawsuit. The lawsuit alleged that a public company filed a false claim to United States Customs in order to undervalue imported goods so as to avoid custom duties.
We immediately filed an appeal to the Ninth Circuit Court of Appeal. I am extremely comfortable that decision will be overturned. It is almost unheard of for a judge not to allow a party to at least file an amended complaint.
