Beware When You Intervene

I represent a company who sued a contractor.  The contractor tendered the claim to its insurance carrier who picked up the defense.  Because the contractor/insured was a suspended corporation the insurance company filed an answer in intervention.  It did so because if I obtained a judgment against its insured I could have immediately sued the insurance carrier to collect that judgment.  An insurance code section allows that type of action.

The insured later decided to pull its defense claiming there was no coverage.  The insurance company filed a Request for Dismissal.  However, because the insurance company filed an answer in intervention and  not a complaint in intervention, I objected to the dismissal.  The court will soom decide if the insurance company will remain a party defendant.
