After a lawsuit is filed and before a trial is set, each party has the right to conduct what is referred to as “discovery”. This means each side can ask the other side for information to be used in proving their case at trial.
The discovery statues are very broad and the courts take a liberal policy in allowing discovery to proceed. However, many attorneys try to interfere with the right to discovery by filing frivilious objections and refusing to answer interrogatories or produce documents. When this happens, the party propounding the discovery needs to file a motion in the court for an order compelling discovery. It is often a waste of everyone’s time and money.
It is a much better practice to comply with discovery since the courts take a dim view of when a party has to file a discovery motion.
